1. Miraculous Sequence, Lda, (MS) taxpayer 516288326, with registered office at Estrada da barragem Sitio da Moira, 491F, Odiáxere Lagos, as the commercial entity of the HERDADE BONANZA FUN AND EVENTS space, assigns to the CLIENT, the space determined in this agreement and under the conditions agreed therein and at the price defined.
1.1 MS holds the compulsory insurance for the activity in accordance with the law in force.
2. MS provides the CUSTOMER with all the information in verbal or written form, also through the rules boards present throughout the space, which will be rented by the CUSTOMER in order for it to be used correctly and safely.
2.1 The CLIENT is solely responsible for the space they rent and must ensure that all safety rules and good use of the space are complied with by all users under their responsibility and that they follow the rules stipulated by MS which are duly displayed.
2.2 MS is not responsible for theft of goods in the CLIENT's care, and it is the CLIENT's responsibility to ensure their safety.
3. The deadline for using the space is set out in this agreement and MS must make the space available at the agreed time and the CLIENT must leave at the scheduled time.
3.1. Failure by the CUSTOMER to comply with the departure time may result in an extra penalty on the rental amount.
3.2 It is hereby stipulated that overtime will cost €100 (one hundred euros) on the AQUANINJA, COWBOYS, FUTOLOCO, FORMULA 1 and INDOOR pitches and €250 (two hundred and fifty euros) for the PRAÇA BELO CANTINHO and RESTAURANTE/PÁTIO pitches and unless otherwise available for use.
4. Payment for the use of this space is determined in this agreement and the corresponding 20% of the total amount must be paid at the time of signing.
4.1 The remaining amount must be paid by the CLIENT by the date of the event and before the event takes place.
4.2 In the event that the event cannot take place due to weather conditions, the deposit amount may be used as a credit for a future booking, but will not be refunded, unless analysed by management.
4.3 Non-refundable deposit for cancellation of events by the CLIENT less than 7 calendar days before the date of the event.
4.4 Refundable deposit of 50% for bookings cancelled between 7 and 15 days before the event.
4.5 Security deposit refundable in full to the CLIENT in the event of cancellation 15 days prior to the event.
4.6 Fully refundable deposit to the client should MS need to cancel the event.
5. MS guarantees the CUSTOMER that the equipment is in usable condition.
5.1. The CUSTOMER must guarantee the upkeep of the equipment delivered to them and immediately notify MS, via the means of contact provided, in the event of any anomalies or malfunctions.
5.2 In the event that MS finds any damage resulting from the incorrect use of the equipment or objects made available, MS may request compensation for damages from the CLIENT.
5.3 The CLIENT is aware of the rules established for each field, which are duly displayed, and guarantees compliance with them in order to make the best use of them for everyone's safety.
5.4 In the event that the CUSTOMER fails to respect the stipulated rules in a damaging and repeated manner, MS may immediately terminate the CUSTOMER's use of the space and the CUSTOMER must leave the premises without the right to a refund.
6. The legal provisions applicable to contracts of this kind shall apply in all matters not covered herein, and only the Faro District Court shall have jurisdiction to settle any disputes arising therefrom.
